PRIVACY POLICY & DATA PROTECTION FRAMEWORK

LEGAL STATUS & ORGANISATION DETAILS

VIZZVE MICROSEVA FOUNDATION (“VIZZVE”, “we”, “our”, “us”) is a company incorporated under Section 8 of the Companies Act, 2013, having its registered office at:

1st Main, 1st Cross, Off Koramangala Ring Road, Viveknagar Post, Ashwini Layout, Ejipura, Bengaluru – 560047, Karnataka, India

VIZZVE operates in compliance with:
● Information Technology Act, 2000
● Information Technology (SPDI) Rules, 2011
● RBI Digital Lending Guidelines (as applicable)
● Applicable micro-finance, charitable, and financial service laws

This Privacy Policy is an electronic record and legally binding agreement under the Information Technology Act, 2000 and does not require any physical or digital signature.
2. SCOPE & APPLICABILITY
This Policy applies to:
● Website: https://vizzve.com/loan/
● All VIZZVE mobile applications, including KYC-related applications
● All users, borrowers, applicants, visitors, agents, partners, and service users

By accessing, registering, or using any VIZZVE service, you expressly acknowledge, agree, and consent to this Policy. If you do not agree, you must immediately discontinue use of our services.
3. NATURE OF SERVICES & USER RESPONSIBILITY
VIZZVE provides financial facilitation and loan-related services on a best-effort and policy-driven basis.

VIZZVE:
● Does not guarantee loan approval, disbursal, renewal, or continuation
● Does not provide financial advice
● Does not compel any user to take a loan

All loans are:
● Eligibility-based
● Risk-assessed
● Policy-driven
● Revocable
● Non-obligatory

The decision to apply for and accept a loan is entirely voluntary and at the sole discretion of the user.
4. INFORMATION WE COLLECT (MINIMUM NECESSARY BASIS)
A. Personal Information
● Name, gender, date of birth
● Phone number, email address
● Residential address and PIN code
● KYC documents (masked Aadhaar, PAN, DL, Voter ID, Passport, etc.)
● Bank account details (only for disbursal and repayment)

B. Financial & Credit Information
● Income and employment/business details
● Bank statements
● Credit bureau data
● Loan amount, tenure, EMI, repayment history

C. Mobile & Device Information (Only With User Permission)
● Device ID, IP address
● App usage logs
● SIM verification status
● Financial SMS (read-only, automated parsing only)
● Location data (PIN code and device-enabled location)

If permissions are denied, certain services may not function. This is a technical requirement, not coercion.
5. KYC & THIRD-PARTY KYC APPLICATIONS
For regulatory and fraud-prevention purposes, users may be required to complete KYC through:
● VIZZVE’s application, or
● A VIZZVE-authorised third-party KYC application

Key points:
● Data collected remains identical
● Data is stored on secured servers
● Data is used only for identity verification and compliance
● No commercial resale of biometric or KYC data

Failure to complete KYC automatically renders the user ineligible for services.
6. PURPOSE OF DATA USAGE
User data is collected and processed strictly for:
● Identity verification
● Credit risk assessment
● Loan processing and servicing
● Fraud prevention and security
● Regulatory and legal compliance
● Customer communication
● Lawful recovery coordination
● Internal analytics using anonymised data

VIZZVE does not sell personal data as a primary business activity.
7. DATA RETENTION
● Personal data is retained for a minimum of 10 years or as required by law
● Thereafter, data is securely deleted or anonymised
● Retention does not imply ongoing service, obligation, or liability
8. DATA SHARING & DISCLOSURE
Data may be shared strictly on a need-to-know basis with:
● RBI-regulated banks and NBFCs
● Credit bureaus
● Payment service providers (e.g., Cashfree)
● Hosting and infrastructure providers (e.g., Hosting Raja)
● Technology and compliance vendors under confidentiality agreements

VIZZVE is not responsible for independent misuse of data by third parties beyond reasonable contractual and legal control.
9. COMMUNICATION, RECOVERY & HARASSMENT POLICY
VIZZVE strictly prohibits and does not authorise:
● Physical intimidation
● Verbal abuse
● Threats or coercion
● Public shaming
● Workplace harassment
● Contacting unrelated persons except as permitted by law

Any misconduct by external recovery agents is independently actionable and shall not be presumed to be VIZZVE’s intent without proof.

By availing services, users expressly consent to lawful communication regarding dues, reminders, and recovery in compliance with applicable law.
10. ASSUMPTION OF RISK & NO LIABILITY FOR EXTREME EVENTS
By using VIZZVE services, users voluntarily acknowledge and accept that VIZZVE shall not be liable, directly or indirectly, for:
● Emotional distress or mental agony
● Financial stress or pressure
● Business loss or income loss
● Health deterioration
● Family or personal disputes
● Self-harm, suicide, or death

Nothing in this clause limits liability where prohibited by law.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
● VIZZVE’s total liability, if any, shall not exceed the actual service fee paid by the user
● No indirect, incidental, punitive, or consequential damages are claimable
12. FORCE MAJEURE
VIZZVE shall not be liable for failure or delay caused by events beyond reasonable control, including cyberattacks, system outages, government actions, natural disasters, or power and internet failures.
13. USER OBLIGATIONS
Users agree to:
● Provide accurate and truthful information
● Safeguard login credentials
● Read and understand loan terms
● Repay dues responsibly
● Use grievance mechanisms honestly

Frivolous, false, or malicious complaints may attract legal consequences under applicable law.
14. GRIEVANCE REDRESSAL

Timings: 10:30 AM – 6:00 PM (Monday to Friday, excluding public holidays)

Grievances must be supported with relevant details and evidence. Incomplete or abusive complaints may be closed without action.
15. POLICY MODIFICATIONS
VIZZVE may update this Policy from time to time without prior notice. Continued use of services constitutes acceptance of the revised Policy.
16. GOVERNING LAW & JURISDICTION
This Policy shall be governed by the laws of India.
Exclusive jurisdiction: Courts of Bengaluru, Karnataka.
